Default Taking OSCommerce off site?

I have seen several sites that are slightly modified from the original OSC most being in mere color schemes, and with maybe a contrib or three added.

Can these sites legally take off the OSC link and powered by at the footer since it still IS OSC???

Legally or not, people still do it. I think the basic design is copyrighted, so, no they really should not take the link off. But, if they change the colors, and the basic graphics, it may qualify as modified. I think this is discussed at great length at the oscommerce forums. Do a search and I am sure you will be reading for hours...
