Free Shipping bug - new one

I fixed the bug where a customer puts in enough things into his cart to get free shipping, goes into the shipping to get flagged for free shipping, then removes the items and still gets free shipping. BUT

A customer ordered a $49 (we do free shipping over $50) item yesterday and we discovered that if they go all the way through out of our site, to our bank's credit card payment gateway, don't pay, THEN return to our site and go through shopping cart, shipping etc etc the shipping charge disappears. I can pm the site so one of the devs can verify and suggest a fix?

If you could just post more details - what shipping and payment modules are you using to cause this? What version of osCmax?

version 2.0 rc3 I'm looking to redo the site on 2.5 once it's out of beta.

flat rate shipping module with the free freight feature being used (which also does free freight if you forget to enter a weight)

payment module is a custom job we had made for our merchant facility.
